HC Grants Four Weeks Time to Brahmaputra Board to File Affidavit

The Division Bench of the Gauhati High Court comprising of the Chief Justice, Ajit Singh and Justice Suman Shyam by order dated 06.06.2016 passed in PIL No. 94/2014 (Sri Rajeeb Kalita – Vs – The State of Assam & 36 ors.) has granted four weeks time to Brahmaputra Board for filing appropriate response to the PIL filed in the back drop of last year’s flood devastation in Assam. The Deputy Commissioners of Sonitpur, Nagaon, Tinsukia and Dibrugarh Districts have filed their affidavits.
The PIL was filed on 08.09.2015 for taking adequate long time permanent measures for controlling floods and its impact in the State. Mr. S.C. Kayal, Assistant Solicitor General of India appeared for the Central Government and the Brahmaputra Board. Ms. B. Goyal, Counsel appeared for the State of Assam.
PIL on Cataract Surgery- News Update
The Division Bench of the Gauhati High Court comprising of the Chief Justice, Ajit Singh and Justice Suman Shyam by order dated 06.06.2016 passed in PIL No. 132/2015 (Sri Rajeeb Kalita – Vs – Union Of India & 12 ors.) to file the counter affidavit and to produce the enquiry report in terms of the earlier order dated 22.04.2016 of the Court.
On the bungle cataract surgery conducted in the Mohendra Mohan Choudhury Hospital (MMCH), Guwahati on 27.11.2015, a PIL was filed by Sri Rajeeb Kalita. The operations were conducted by Dr. (Mrs.) Bindu Singla, Medical and Health Officer-1 of the said Hospital. Ten patients were referred to Sri Sankardeva Netralaya Hospital on 30.11.2015 and out of them five were found to be cases of Endophalmitis and accordingly, Evisceration procedure (complete removal of the infected eye) was done on then, as there was no other treatment available for the bad infected eyes. The patients were discharged on 03.12.2015.
Kamalpur Constituency- News Update
The Gauhati High Court directed the Public Prosecutor, Assam to produce the Case Diary of Panbazar P.S. Case No. 135/2016 under Section 376/420/313 I.P.C. in response to the Bail Application No. 468/2016 filed by Sri Pranjit Choudhury former State Vice-President of National Youth Congress and a candidate of INC for Kamalpur Constituency in the last LAC Election held on 11.04.2016.
Mr. Bhaskar Dev Konwar, Senior Advocate, assisted by Mr. R. Saloi, counsel states that the FIR was filed by the alleged victim woman alleging that since in the Month of November, 2016 she was in love relationship with Pranjit Choudhury and since then he has been proposing her to marry and she also got pregnant. It was further stated by the victim girl that she was asked to wait till the election day and on 12.04.2016 when she approached him with her rights, till the last moment he used to tell that he would marry her and in the night of 13.04.2015 at 11.00 P.M. he left her at Hotel Brahmaputra and thereafter, he disconnected his communication with her. A prayer was made to the Police to do the needful and to punish the culprit and on the basis of the said FIR an offence under section 376/420/313 I.P.C. was registered against Pranjit Choudhury. Mr. Hrishikesh Sarma, Additional Public Prosecutor represented the State of Assam. At present Pranjit Choudhury is under judicial custody at the Central Jail, Guwahati till 16.06.2016.
