SC paves the way for Government formation in Arunachal Pradesh

Kalikho pulThe Supreme Court on Thursday gave the go-ahead for the formation of a new government in Arunachal Pradesh by vacating it’s yesterday’s status quo order.

A five-member Constitution Bench headed by Justice JS Khehar passed the order after perusing records pertaining to the disqualification of 14 rebel Congress MLAs. The Bench found fault with the procedure adopted by the Speaker for acting against the rebel MLAs.

It may be mentioned here that on Wednesday, Supreme Court had ordered maintenance of status quo in the crisis-ridden state till it examined judicial and assembly records on disqualification of 14 rebel Congress MLAs by former speaker Nabam Rebia. In this context the court has sought report from the Arunachal government and also from the Guahati High Court in sealed covers.

On Wednesday in its interim order that came after senior lawyers FS Nariman and Kapil Sibal, appearing for Arunachal Congress leaders, sought maintenance of status quo till their plea seeking to restrain governor JP Rajkhowa from swearing in a new government in Arunachal Pradesh was decided, the apex court had stayed the process of formation of goverment in the state.
